SettleSmart Pty Ltd ("SettleSmart", "we", "us") operates the SettleSmart platform — a marketplace connecting consumers with OMARA-registered migration agents, QEAC-certified education counsellors, and immigration lawyers. We are headquartered in Adelaide, South Australia, and operate under the Australian Privacy Act 1988.
We collect information you provide when registering, booking, or using the platform. This includes: name, email address, phone number, country of origin, visa situation details, documents uploaded to the Document Vault, payment details (processed by our payment provider — not stored by SettleSmart directly), and session recordings (with consent).
Your information is used to facilitate bookings and consultations, verify professional registrations, process payments, provide customer support, improve our platform, and comply with legal obligations. We do not sell your personal data to third parties. We do not share your information with professionals beyond what is necessary to deliver your booked consultation.
Documents uploaded to the SettleSmart Document Vault are encrypted in transit and at rest. Access is restricted to you and the professional you have an active booking with. Documents are automatically deleted 90 days after your last session unless you have an ongoing engagement.
Under the Australian Privacy Act, you have the right to access, correct, and request deletion of your personal data. To exercise these rights, contact us at [email protected]. We respond to all privacy requests within 30 days.

SettleSmart is a marketplace platform that facilitates connections between consumers and independently registered migration professionals. SettleSmart is not a registered migration agency and does not provide migration advice. All advice is provided by the individual professionals listed on the platform.
SettleSmart verifies migration agent registrations against the live OMARA register and education counsellor certifications against QEAC records at the time of onboarding. We re-verify registrations periodically. However, SettleSmart cannot guarantee the ongoing accuracy, quality, or outcome of advice provided by professionals on the platform.
All consultation payments are held in escrow until the session is marked complete by both parties. In the event of a disputed session, SettleSmart's dispute resolution team will review the case and determine the appropriate disbursement. Refunds for incomplete sessions are processed within 2 business days.
Users may not use SettleSmart to engage in fraudulent activity, impersonate professionals, provide false information, circumvent the platform's payment system, or solicit professionals to work outside the platform. Violations will result in immediate account suspension and may be reported to OMARA or relevant authorities.
SettleSmart's liability is limited to the value of the booking fee paid. SettleSmart is not liable for visa outcomes, educational outcomes, or consequences arising from advice given by professionals on the platform. Professionals carry their own professional indemnity insurance as required by OMARA.
These Terms are governed by the laws of South Australia, Australia. Any dispute will be subject to the exclusive jurisdiction of the courts of South Australia.
How SettleSmart operates within Australian regulatory frameworks — and how we protect you.
All migration agents on SettleSmart hold a current Migration Agent Registration Number (MARN) issued by the Office of the Migration Agents Registration Authority. MARN numbers are displayed on every profile and verified against the live OMARA register. Agents with lapsed or suspended registrations are automatically removed from the platform.
Visit OMARA Register →Education counsellors on SettleSmart comply with the Education Services for Overseas Students Act 2000. Counsellors must hold valid sub-agent agreements with CRICOS-registered institutions or hold QEAC certification. SettleSmart does not recruit international students directly and operates as a facilitating marketplace only.
ESOS Act legislation →SettleSmart handles all personal and sensitive data in accordance with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs). Personal data is never sold. Sensitive documents are encrypted at rest and in transit. Users may request access, correction, or deletion of their data at any time.
SettleSmart complies fully with the Australian Consumer Law. All fees are displayed transparently before booking. Professionals on the platform are prohibited from making guarantees about visa outcomes or admission results. Our dispute resolution process is documented and accessible to all users.
If you believe a professional on SettleSmart has acted improperly or outside their registration conditions, please contact our compliance team immediately. All reports are treated confidentially and investigated within 5 business days.

You must provide honest, accurate, and up-to-date advice to all clients. You must not make guarantees about visa outcomes or admission results. If you are unsure about a matter, you must say so clearly and refer the client to an appropriate source.
You must maintain your OMARA registration (or QEAC certification) in good standing for the duration of your listing on SettleSmart. You must notify SettleSmart immediately if your registration lapses, is suspended, or is subject to a complaint or investigation.
All client information — personal details, visa situation, documents — is strictly confidential. You must not share client information with any third party without the client's explicit consent, unless required by law.
Your listed rate on SettleSmart must be accurate and all-inclusive. You must not charge clients additional fees outside the platform for services covered in the consultation. Any full-service engagements must be documented with a clear fee agreement before work commences.
All interactions with clients must be conducted with professionalism, cultural sensitivity, and respect. Discriminatory behaviour, harassment, or conduct unbecoming of a registered professional will result in immediate removal from the platform and may be reported to OMARA.
You must not solicit clients to circumvent SettleSmart's payment system, post fake reviews, misrepresent your credentials or experience, or act in any way that would bring SettleSmart or the migration profession into disrepute.
Breaches of this Code of Conduct
May result in immediate suspension, removal from the platform, and referral to OMARA, ASQA, or other relevant regulatory bodies depending on the nature of the breach.
